OLD LYME PLANNING COMMISSION
REGULAR MEETING
THURSDAY, MARCH 9, 2017
PRESENT WERE: Harold Thompson, Robert McCarthy, Steven Ross, Chris Kerr and Alternate Don Willis seated for Edgar Butcher, Alternate Barbara Gaudio and Attorney Cassella.

DISCUSSION – PLAN OF CONSERVATION & DEVELOPMENT – SALT MARSH ADVANCEMENT & SEA LEVEL RISE
Ed Cassella, Planning Commission Counsel presented the commission with a revised draft of the proposed Modifications to the Plan of Conservation and Development. Ed Cassella reviewed the revisions with the commission. Steven Ross stated he felt there was redundancy in the 3rd paragraph of the first page and the first paragraph of the second page. Cassella said on the first page it was intended to be a general outline and in the second paragraph was a little more specific including the elevating of structures. Ross suggested to decrease the wording in paragraph 3 on Page 1 and add that language to the second page. It was agreed that the two paragraphs should complement each other.
Steven Ross asked counsel, if the town is well aware of the potential risks of coastal flooding would the failure to take any action in terms of regulatory changes open the town to a liability from someone who wants to take pre-empted action and is not able to do so without incredible complication. Ross asked if this was a potential legitimate legal argument.
Attorney Cassella stated the town does provide a process to elevate a structure and the goal is to minimize the expense and hurdles.
Discussion ensued and the commission agreed to send out the revised proposal to the other land use commissions for their input.
READING AND APPROVAL OF THE FEBRUARY REGULAR MEETING MINUTES.
Steven Ross made a motion to waive the reading and approve the minutes as submitted. Don Willis seconded the motion. The motion passed unanimously.
